Children and costs

The following topics may arise in the context of children and costs:

Retainers: It is not always immediately obvious how best to ensure compliance with the indemnity principle. The costs team are able to advise on this (both in respect of individual cases, and in respect of the appropriate procedures to be adopted generally).

Settlements: Costs settlements need to be approved in exactly the same way as do other compromises. Because the costs team has good quantum skills, they are ideally placed to draft such advices, and will often be able to do so without the assistance of a costs draftsman.

Disputes between the litigation friend and the child): These disputes require delicate handling; the costs team will advise whether they should be litigated or dealt with by ADR.
