Cases involving European protected species and other important habitats are extraordinarily complex.

The UK is pepperpotted with areas which are protected under European or International law. How the Domestic Planning Systems accommodates development in and around such sites has troubled the Courts over many years.

The experience of the South East in recent years in the area of the Thames Basin Heath was of multiple developments being frustrated by developers failing to understand the scheme of parallel control relating to Habitats protection and in particular the need for Appropriate Assessments. As that experience is now being repeated throughout the UK it is imperative for all those interested in the outcome of a given development proposal that Habitats Protection is fully understood and dealt with.
