The law relating to the Environmental Impact of developments has been one of the most complicated and fast moving of any area of law in the last two decades. It involves a fusion of European and Domestic legislation, and the threat of a high court challenge is ever present.

Members of Chambers regularly advise upon and undertake audits of Environmental Impact Assessments, in order to try to minimise the threat of such challenge. In major applications an understanding of this area of law is crucial and members of Kings Chambers are therefore well placed to provide clear and commercial advice upon the efficacy of the content of an EIA.

From the perspective of those anxiously scrutinising an EIA on behalf a LPA or a Third Party members of Chambers have been involved in a number of successful challenges based upon the adequacy or procedural efficacy of an EIA. 

It cannot be stressed strongly enough that this is an area where the best advice is worth paying for.
