It is difficult to underplay the impact of TUPE on employment litigation. It pervades all aspects of the practice of employment law and might fairly be described as a trap for the unwary. Crucial in this technical and complicated area is early access to experienced and commercial advice. Kings Chambers’ Employment team has unrivalled experience in this area of practice.

Members of the team have been involved in decisions extending the application of TUPE to trans-national transfers outside the territorial scope of the EU and in defining the concept of a “service provision change” introduced by the TUPE 2006 Regulations. The team practises in all facets of TUPE litigation including advising as to the potential application of TUPE to a putative transfer and how to manage the potential consequences of the same on behalf of employers, employees and trade unions. Members regularly appear in unfair dismissal claims brought on the basis of TUPE and appear in collective information and consultation claims arising from a TUPE transfer. We regularly advise licensed insolvency practitioners as to the impact and reach of TUPE as regards liquidation, insolvency and related proceedings.
