Collective Labour Disputes and Trade Union Litigation
Recent economic developments have brought collective industrial law to the forefront of public attention. Once again large scale industrial litigation is a reality as opposed to a relic of the 1970s. Crucial to all parties in litigation of this nature is early access to experienced and commercial advice.
Members of Kings Chambers’ Employment team regularly appear in this area of practice of behalf of both employers and unions. Members of the team have appeared on behalf of both local authorities and NHS trusts in the defence of collective contractual claims often arising from job evaluation and re-grading exercises. They also appear on behalf of various unions in prosecuting a number of collective contractual claims against employers of all sizes. Members of the team regularly advise on and appear in claims by individual union members who have been less favourably treated by reason of their union membership, in collective bargaining and in union recognition claims. They are equally adept in defending and prosecuting applications for injunctive relief as regards proposed industrial action. Instructions are accepted on a direct access and direct professional access basis.
