Commercial Dispute Resolution

Johnny has extensive experience of High Court and County Court multi-track litigation and trials involving:

Contractual disputes, sale of goods, banking and finance, share disputes, guarantees and indemnities, insurance, factoring agreements, directors / company disputes, international supply agreements, confidential information and springboard injunctions, sponsorship and brand exploitation etc, shipping.

Examples of recent work include: High Court trials in London and Manchester involving sale of goods, share disputes, and limitation; acting for a top-four Premier League football club in relation to a dispute with a major sponsor; a range of interim applications in the High Court and County Court including injunctions and security for costs.

Construction

A significant proportion of Johnny's practice is in construction and IT, and he regularly deals with cases involving:

Defects, delay, payment disputes, extensions of time, concurrent delay, third party nuisance actions, parent company guarantees / performance bonds, limitation of claims, professional negligence, JCT and other standard forms, plant hire; and computing / IT defect / delay claims.

Johnny also undertakes a significant amount of adjudication and arbitration work including advising on and preparing adjudication and arbitration proceedings, and enforcing / resisting enforcement in the High Court.

Professional Negligence

Johnny is regularly instructed on behalf of defendants and claimants in relation to actions involving architects, surveyors, solicitors and others. In addition, a fair proportion of Johnny's construction practice has a professional negligence element, whether in the main action or in an associated part 20 claim. Examples of recent work include actions against a project manager, quantity surveyors, contract administrators, solicitors in relation toa commercial property transaction, and architects in relation to a substantial development in Belfast.

 

Insurance Disputes, Insured Loss and Subrogated Recovery

Johnny’s insurance practice includes policy coverage disputes, and advice and representation in relation to insured losses.  Examples of recent work include claims arising out of oil and petrol spills, floods, fires, a collision between a lorry and a railway bridge, damage to underground pipelines, cables and equipment, defective goods, and building collapses / construction site accidents. Policy coverage work has included personal injury and death arising out of defective equipment, improper supervision etc, as well as business interruption and property damage.
