Profile

Catherine practises across the entire spectrum of personal injury work including clinical negligence, public and employers' liability and road traffic litigation and is on the list of Crown Counsel (Provincial Panel).

Catherine enjoys a busy industrial disease practice based primarily around asbestos related and other lung diseases, industrial deafness and HAVS as well as upper limb disorders, asthma and dermatitis.  Catherine has experience of cross examining experts in contested industrial disease trials and acting in trials of preliminary issues including limitation.

She has been instructed by the Crown in concluded group litigation arising out of coal mining and is presently second junior counsel in the ongoing group litigation regarding osteoarthritis of the knee in miners.

Catherine successfully represented the Appellant before the Privy Council.  The Appeal concerned the exercise of discretion to commence a trial in the Defendant's absence.

ANDREW CLARK v J D CLARK (T/A J O CLARK & SONS) (2006) LTL 23/2/2007

Acted for the Defendant in a Multi-track trial concerning the foreseeability of injury in the farming industry with sporadic exposure to vibration.

AMANDA CLARKE (NEE BERRY) (Claimant) v OLDHAM METROPOLITAN BOROUGH COUNCIL (Defendants/Applicants) & SMITH JONES SOLICITORS (Respondents) (2008) LTL 30/9/2008

Acted for the Defendant/Applicant in obtaining a non-party costs order against the Claimant's solicitors in circumstances where the Claimant had lost at trial but did not have the benefit of legal expenses insurance to pay the costs order made in favour of the Defendant.
