Important TUPE Decision

Nicholas Siddall has recently been successful in securing on behalf of the GMB Union a significant clarification as to the territorial extent of the TUPE Regulations. In the decision of
Holis Metal Industries-v-The GMB and Newell the EAT held that the TUPE Regulations and
the Acquired Rights Directive apply to a transfer of an undertaking from within the European
Union to a country outside of the territorial scope of the EU Treaty. A copy of the decision of the
